Last updated: 14 October 2026
OVERVIEW
Welcome to Delmark Group.
This website is operated by Delmark Group Ltd. Throughout this website and these Terms of Service, the terms “we”, “us” and “our” refer to Delmark Group Ltd.
Delmark Group Ltd develops and supplies security products and solutions, including Drop Lock, our purpose-built emergency lockdown device.
Our website, products, information, content, features, tools and related services are collectively referred to in these Terms as the “Services”.
Our online store and website are hosted using Shopify, which provides the ecommerce platform that enables us to make our Services available to you.
By visiting our website, requesting information, submitting an enquiry, requesting a quotation, purchasing a product or otherwise using our Services, you agree to these Terms of Service.
Please read these Terms carefully before using our website or purchasing from us.
Nothing in these Terms affects any statutory rights that cannot legally be excluded or restricted.
SECTION 1 – ACCESS AND ACCOUNT INFORMATION
By using our Services, you confirm that you are legally able to enter into an agreement with us.
You may be asked to provide information including your name, organisation, email address, billing information, delivery information and other details necessary for us to respond to enquiries, provide quotations, process orders or deliver our Services.
You agree that information provided to us will be accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your account details and for all activity carried out using your account.
You must not transfer, sell or provide your account access to another person without our prior written permission.
SECTION 2 – OUR PRODUCTS
Delmark Group Ltd supplies security products including Drop Lock.
We make reasonable efforts to ensure product descriptions, photographs, drawings, specifications and other information displayed on our website are accurate.
However, products may continue to be developed, improved or modified and minor differences may occur between website images, prototypes, technical illustrations and final production products.
Colours, finishes and product appearance may also vary depending on screen settings, manufacturing tolerances and materials.
We reserve the right to change, improve, replace or discontinue products or specifications where reasonably necessary.
Any specific technical requirements agreed as part of a written quotation, specification or order confirmation will take precedence over general information shown on the website.
SECTION 3 – ORDERS AND QUOTATIONS
A quotation provided by Delmark Group Ltd does not constitute acceptance of an order unless expressly confirmed by us.
When you submit an order or accept a quotation, you are making an offer to purchase the relevant products or Services.
An order becomes binding when Delmark Group Ltd confirms acceptance in writing, issues an order confirmation or otherwise expressly accepts the order.
We reserve the right to accept or decline an order where reasonably necessary.
If we are unable to accept an order, we will notify you and, where payment has already been received for an order we cannot fulfil, arrange an appropriate refund.
You are responsible for checking all specifications, quantities, installation requirements, delivery information and other order details before confirming an order.
Custom, bespoke, modified or bulk orders may not be cancellable once manufacture, procurement or preparation has begun.
Drop Lock products are primarily supplied for professional, organisational, commercial and institutional use.
SECTION 4 – PRICES AND PAYMENT
Prices may be provided on our website, in quotations, invoices or other written communications.
Unless expressly stated otherwise, prices may be exclusive of VAT, delivery, installation and any other applicable charges.
Where VAT applies, it will be charged at the applicable rate.
Prices and quotations may change from time to time.
A quotation will normally remain valid for the period stated on that quotation.
You agree to provide accurate and complete billing and payment information.
Payment terms will be those shown on the relevant quotation, invoice or order confirmation.
Where payment is overdue, we reserve the right to pause manufacture, delivery, installation or other Services until payment is received.
SECTION 5 – SHIPPING, DELIVERY AND INSTALLATION
Any delivery or installation dates provided are estimates unless expressly confirmed otherwise in writing.
We will make reasonable efforts to meet agreed timescales, but delays may occasionally occur due to manufacturing, supply chains, carriers, site access, testing requirements or circumstances outside our reasonable control.
Where installation is included, the customer is responsible for providing reasonable access to the premises and ensuring the installation area is available and safe for our installers.
Any unusual site conditions, hazardous materials, restricted access, unsuitable doors, floors, frames or other conditions that may affect installation should be disclosed before installation.
Additional work outside the agreed scope may incur additional charges, which will be discussed before that additional work is carried out wherever reasonably practicable.
SECTION 6 – INTELLECTUAL PROPERTY
The content of this website, including text, graphics, photographs, drawings, videos, logos, product designs, branding and other materials, is owned by or licensed to Delmark Group Ltd unless otherwise stated.
The Delmark Group name, branding and logo, and the Drop Lock name, branding, product designs and associated materials, are owned by or licensed to Delmark Group Ltd.
Nothing in these Terms grants you ownership of any intellectual property belonging to Delmark Group Ltd.
You must not copy, reproduce, modify, manufacture, reverse engineer, distribute, publish, sell or commercially exploit our intellectual property without our prior written permission, except where permitted by law.
Nothing in these Terms transfers any patent, design right, copyright, trademark or other intellectual property right to you.
All rights not expressly granted are reserved.
SECTION 7 – THIRD-PARTY TOOLS AND SERVICES
Our website may provide access to third-party tools, services or integrations.
We do not necessarily control these third-party services and their use may be subject to separate terms and privacy policies.
Where we provide access to a third-party tool, you are responsible for reviewing and accepting any applicable third-party terms.
We may introduce, change or remove third-party tools or integrations from time to time.
SECTION 8 – THIRD-PARTY LINKS
Our website may contain links to websites or services operated by third parties.
We are not responsible for the content, availability, accuracy, privacy practices or security of third-party websites.
Following a third-party link is at your own discretion.
Any complaints or questions regarding products or services supplied by a third party should be directed to that third party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Our website and online store use Shopify technology.
Shopify provides ecommerce and website infrastructure to Delmark Group Ltd.
Any sale of products or Services offered directly by Delmark Group Ltd is made between you and Delmark Group Ltd, not Shopify.
Shopify is not responsible for the design, manufacture, installation, performance or suitability of Drop Lock or any other product supplied by Delmark Group Ltd.
Shopify may process certain information in connection with operation of the website and online store in accordance with Shopify’s own privacy practices.
SECTION 10 – PRIVACY
Our collection and use of personal information is governed by our Privacy Policy.
Certain information may also be processed by Shopify and other service providers that support our website, communications, payments, analytics, marketing, delivery or other business operations.
Please review our Privacy Policy for further information.
SECTION 11 – FEEDBACK AND SUBMISSIONS
If you voluntarily provide us with suggestions, comments, ideas, reviews or feedback relating to our products or Services, you grant Delmark Group Ltd permission to use that feedback for legitimate business purposes including product development, service improvement and marketing.
You confirm that any material you provide will not knowingly infringe the intellectual property, privacy or other legal rights of another person.
We are not obliged to implement suggestions or provide compensation for unsolicited ideas or feedback unless separately agreed in writing.
SECTION 12 – ERRORS AND INACCURACIES
Occasionally our website or communications may contain typographical errors, technical inaccuracies or omissions.
These may relate to product information, specifications, availability, pricing or other content.
We reserve the right to correct genuine errors and update information where reasonably necessary.
If an error materially affects an order already placed, we will contact you and explain the available options.
SECTION 13 – ACCEPTABLE USE
You must not use our website or Services:
- for unlawful or fraudulent purposes;
- to infringe another person’s intellectual property or legal rights;
- to introduce viruses, malicious code or harmful software;
- to attempt to gain unauthorised access to our systems;
- to interfere with the operation or security of our website;
- to scrape, extract or systematically collect protected content for unauthorised commercial use;
- to impersonate another person or organisation;
- to submit deliberately false or misleading information; or
- to use our Services in any way that may cause unlawful harm to Delmark Group Ltd, our customers, partners, employees or other users.
We reserve the right to restrict access to our Services where we reasonably believe these Terms have been breached.
SECTION 14 – AUTOMATED SYSTEMS AND AGENTS
Automated tools, software agents or artificial intelligence systems must not access or interact with our Services in a way that circumvents security measures, interferes with normal website operation or extracts protected information without permission.
We may use reasonable technical measures to prevent abusive or unauthorised automated access.
Nothing in this section prevents legitimate search engines, accessibility tools or authorised services from accessing our website in accordance with applicable standards and permissions.
SECTION 15 – TERMINATION OR SUSPENSION
We may suspend or terminate access to parts of our Services where reasonably necessary because of misuse, suspected fraud, unlawful activity, security concerns or material breach of these Terms.
Termination does not affect rights or obligations that arose before termination.
Provisions relating to intellectual property, payment, liability, confidentiality and other provisions that are intended to continue after termination will remain in effect.
SECTION 16 – PRODUCT AND WEBSITE DISCLAIMERS
We aim to provide accurate and useful information about our products and Services.
However, general information on the website should not be treated as a substitute for a site-specific assessment, professional specification, regulatory assessment or installation requirement where one is necessary.
Suitability of a security product can depend on factors including the particular door, frame, floor, building, escape route, fire strategy, building use and applicable standards or regulations.
Where professional assessment, testing, certification or regulatory approval is required, those requirements should be considered separately.
Nothing on the website should be interpreted as a guarantee that a particular product will prevent every unauthorised entry, emergency, injury or loss.
Nothing in these Terms excludes any warranty, guarantee or legal obligation that cannot lawfully be excluded.
SECTION 17 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to applicable law, Delmark Group Ltd will not be responsible for indirect or consequential losses that were not reasonably foreseeable at the time the contract was formed.
Where products or Services are purchased for business purposes, Delmark Group Ltd will not be liable for loss of profits, loss of business, loss of anticipated savings, loss of contracts or loss of business opportunity except where such liability cannot legally be excluded.
Any limitation of liability contained in an individual written contract, quotation or supply agreement will apply in addition to these Terms.
SECTION 18 – INDEMNITY FOR UNLAWFUL USE
Where permitted by law, you agree to be responsible for losses reasonably incurred by Delmark Group Ltd as a direct result of your unlawful use of our Services or deliberate breach of these Terms.
This section does not impose liability on you for matters that are the responsibility of Delmark Group Ltd.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found by a court or competent authority to be invalid or unenforceable, the remaining provisions will continue in effect.
Where possible, the invalid provision will be interpreted or modified only to the minimum extent necessary to make it lawful and enforceable.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
These Terms, together with any quotation, order confirmation, specification, Privacy Policy, Refund Policy and other terms expressly incorporated into an order, form the agreement between you and Delmark Group Ltd concerning the relevant Services.
If there is a conflict between these general Terms and a specific written agreement signed or expressly accepted by Delmark Group Ltd, the specific written agreement will take precedence.
SECTION 21 – ASSIGNMENT
You may not transfer your contractual rights or obligations to another party without our prior written consent where consent is reasonably required.
Delmark Group Ltd may transfer its rights or obligations as part of a legitimate business reorganisation, merger, sale or transfer, provided this does not unlawfully reduce your rights.
SECTION 22 – GOVERNING LAW
These Terms and any dispute or claim arising from them will be governed by the laws of England and Wales, unless applicable law requires otherwise.
If you are acting in the course of a business, the courts of England and Wales will have jurisdiction over disputes arising from these Terms unless otherwise agreed in writing.
If you are a consumer, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.
SECTION 23 – HEADINGS
Section headings are included for convenience only and do not affect the interpretation of these Terms.
SECTION 24 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, Services, legal obligations or operating practices.
The current version will be published on our website.
Where required by law, we will provide appropriate notice of material changes.
Your continued use of the website after updated Terms take effect will constitute acceptance of those updated Terms where legally permitted.
